1. Acceptance of Terms

By downloading, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you are prohibited from using or accessing the Service.

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes by posting the new Terms on the Service, updating the "Last Updated" date, or by other means we deem appropriate. Your continued use of the Service after such changes are posted constitutes your acceptance of the new Terms.

2. Eligibility and Account Registration

To create an account and use BeatSphere, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction to consent to use online services). If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Register for an account ("Account") by linking one or more supported music services (such as Spotify, Apple Music, YouTube Music, SoundCloud, or Last.fm) and providing accurate, current, and complete information as prompted by the registration process.
• Maintain the security of your Account credentials and be solely responsible for all activities that occur under your Account. You agree not to share your credentials with others.
• Promptly notify us if you discover or otherwise suspect any security breaches related to the Service or your Account.

3. The Service

BeatSphere is a social music discovery platform that allows users to see what music others are listening to in their vicinity via an interactive map, connect with individuals who share similar music tastes, and engage in conversations about music. The Service includes the following features:

• Interactive Map: A real-time map displaying users and the music they are currently listening to, powered by Mapbox (mobile) and Leaflet (web).
• Music Integration: Connections to third-party music services including Spotify, Apple Music, YouTube Music, SoundCloud, and Last.fm to display your listening activity.
• Chat: Global chat and direct messaging features for communicating with other users in real time, with support for text messages and GIFs.
• Friends: The ability to send and accept friend requests, follow other users, and manage your social connections.
• Territories: A gamification feature allowing users to claim geographic regions based on their listening activity.
• Audio Geo-Drops: The ability to drop audio clips at specific locations for other users to discover.
• AI-Powered Features: Location-based playlist generation and music activity heatmaps powered by our AI service.
• Push Notifications: Alerts for friend requests, messages, nearby friends, and other activity updates.

To provide these core functionalities, the Service requires access to your device's location services. By using BeatSphere, you explicitly consent to the collection, use, and sharing of your location data as detailed in our Privacy Policy. You can manage location sharing preferences through your device's settings.

4. Third-Party Music Services

BeatSphere integrates with the following third-party music services via OAuth authentication:

• Spotify
• Apple Music
• YouTube Music
• SoundCloud
• Last.fm

By linking a music service to your BeatSphere account, you authorize us to access certain information from that service, such as your currently playing track, recently played tracks, and profile information. Your use of these third-party services is governed by their respective terms and privacy policies. We do not control and are not responsible for the practices of these third-party services.

You may disconnect a linked music service at any time through your account settings. Disconnecting a service will stop the collection of new data from that service but will not automatically delete previously collected data.

5. User Conduct

You agree not to use the Service to:

• Post, transmit, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Share any content that exploits, abuses, or endangers children, including Child Sexual Abuse Material (CSAM). See our Child Safety Policy for details.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Stalk, harass, bully, or intimidate other users, either through chat, location tracking, or any other feature of the Service.
• Use the location features of the Service to track, monitor, or surveil other users without their knowledge or consent.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems or networks connected to the Service.
• Use bots, scrapers, or automated tools to access or collect data from the Service.
• Upload or transmit viruses, malware, or any other malicious code.
• Spam other users through chat messages or other communication features.

6. User Content

You retain ownership of content you create and share through the Service, including chat messages, audio geo-drops, and profile information ("User Content"). By posting User Content, you grant BeatSphere a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content and the consequences of sharing it. We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

7. Content Moderation and Reporting

BeatSphere employs content moderation measures including automated content filtering in chat. Users can report other users for spam, harassment, hate speech, inappropriate content, or impersonation through the in-app reporting system or by contacting us directly.

Reports are reviewed by our team. Actions may include content removal, account suspension, or permanent account termination. In cases involving illegal activity, we may report incidents to law enforcement.

8. Territories

The Territories feature allows users to claim geographic regions based on their listening activity. Territory claims are for entertainment purposes only and do not confer any real-world rights, ownership, or control over any geographic area. We reserve the right to modify, reset, or remove territory claims at any time.

9. AI-Powered Features

BeatSphere uses artificial intelligence to generate location-based playlists and music activity heatmaps. These features process aggregated and anonymized listening data to provide recommendations. AI-generated content is provided for entertainment and discovery purposes and may not always be accurate or suitable for your preferences.

10. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BeatSphere. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

11. Account Termination

You may delete your account at any time through the app settings. Upon account deletion, we will permanently delete your account data, including your profile, chat messages, track history, location data, friend connections, territory claims, linked social accounts, and registered devices.

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

We are not responsible for the accuracy of music data provided by third-party services, the behavior of other users, or any content shared by users through the Service.

13. Limitation of Liability

To the maximum extent permitted by law, BeatSphere shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BeatSphere operates, without regard to its conflict of law provisions.
